How Louisiana’s “No Pay, No Play” Law Affects Car Accident Claims

The “No Pay, No Play” law limits recovery when the driver of an uninsured vehicle fails to maintain the required liability coverage (La. R.S. § 32:866). If you’re injured in a crash without valid auto insurance, you are legally barred from recovering the first $100,000 in bodily injury damages and the first $100,000 in property damage, even if the other driver was at fault. 

However, certain exceptions can apply, such as cases involving a DWI conviction or plea, an intentional crash, a hit-and-run, a legally parked vehicle, or a vehicle being used to commit a felony. While this statute can protect claims by insured passengers, it can also wipe out the ability of uninsured drivers to seek justice.

Can I Recover Compensation if I Was Partially Responsible for a Car Crash?

Louisiana operates under a modified comparative negligence rule, meaning plaintiffs can still recover compensation even if they are partially responsible for the accident. However, this only applies if your share of the fault is less than 51%. If your fault is 51% or greater, you may be ineligible to bring a claim.   

If you are found to be partially responsible for the collision, the final payout will be reduced by that percentage. For example, if you are 10% at fault for an accident totaling $50,000 in damages, you may only recover $45,000.
