New Orleans Negligent Security Lawyer
Serving Injured Louisianans Since 2013, With Every Case Prepared for Trial
Assaults, shootings, robberies, sexual assaults, and other criminal acts can leave victims facing serious injuries and difficult questions about a property’s security. Poor lighting, broken gates, inadequate surveillance, missing warnings, and ineffective access controls may support a premises liability claim. Prompt legal review matters because footage, reports, and other evidence can disappear or be overwritten.
We represent injured people throughout Louisiana, including New Orleans. Since 2013, we’ve handled thousands of personal injury cases and recovered more than $10 million. We prepare every case for trial, particularly when insurers dispute foreseeability or try to shift responsibility away from a property owner or operator.

How Louisiana Law Evaluates Foreseeability & Property Responsibility
Under the Posecai framework, Louisiana courts consider the foreseeability and gravity of a criminal risk when deciding whether a business owed a duty to take protective measures. The degree of foreseeability required can depend on the measure at issue. Hiring security guards may require stronger evidence of foreseeable danger than installing better lighting, cameras, or fencing or maintaining vegetation.
Louisiana Civil Code Article 2317.1 may also apply when an unsafe condition or defect contributed to the damage. It addresses knowledge, preventability, and the exercise of reasonable care. Property owners aren’t automatically responsible for every criminal act on their premises. Duty, control, knowledge, and causation depend on the specific facts.
Who May Be Responsible & What Losses May Be Recovered
Criminal acts on unsafe property can cause gunshot wounds, stab wounds, fractures, traumatic brain injuries, spinal injuries, soft tissue damage, permanent disability, and psychological trauma. Fatal incidents may also lead to wrongful death and survival claims, depending on the circumstances and the claimant’s legal relationship to the person who died.
Potential defendants may include a property owner, landlord, business operator, property manager, tenant, or security contractor. Available damages depend on the evidence but may include emergency care, ongoing medical treatment, rehabilitation, lost wages, reduced earning capacity, pain and suffering, emotional distress, and qualifying losses associated with a fatal injury.
What to Do After an Injury on New Orleans Property
Your immediate safety and medical needs come first. Once you’re safe, take practical steps to preserve information that may become important to your claim.
Consider taking these steps:
- Seek appropriate medical care and follow your treatment instructions.
- Report the incident to law enforcement and the property owner or manager when it’s safe to do so.
- Preserve photographs, videos, clothing, receipts, messages, and other available records.
- Record witnesses’ names and contact information without placing yourself in danger.
- Avoid giving an insurer a recorded statement before you understand your rights.
The New Orleans Police Department provides police report and records services for incidents within the city. Depending on the property, parties, and jurisdiction, litigation may proceed in the Civil District Court for the Parish of Orleans.
